سے جو جز وی جمہوری عمل شروع ہوا تھا وہ بھی ختم کر دیا جاتا۔پاکستان کی سپریم کورٹ نے اپنے فیصلہ میں اس امر کی نشاندہی بھی کی کہ آئین پاکستان کے آرٹیکل 239 کا مذکورہ حصہ بھارت کے آئین میں کی جانے والی 1976 42nd Amendment) Act of) سے نقل کیا گیا تھا اور اس کے ذریعہ اندرا گاندھی صاحبہ کے دور میں بھارتی آئین کے آرٹیکل 368 میں ترمیم کی گئی تھی۔اس ترمیم کے الفاظ یہ تھے: "Art۔368۔Power of Parliament to amend the Constitution and procedure therefor: (4) No amendment of this Constitution (including the provisions of Part III) made or purporting to have been made under this article [whether before or after the commencement of Section 55 of the Constitution (Forty-second Amendment) Act, 1976] shall be called in question in any court on any ground۔(5) For the removal of doubts, it is hereby declared that there shall be no limitation whatever on the constituent power of Parliament to amend by way of addition, variation or repeal the provisions of this Constitution under this article۔۔" اس ترمیم کے آخری حصہ میں یہ واضح کیا گیا تھا کہ پارلیمنٹ کے پاس آئین میں ترمیم کرنے کا غیر محدود اختیار موجود ہے اور پارلیمنٹ جس طرح چاہے آئین میں اضافہ 218
